Rights of return of products and services offered for sale on www.acvaticbebeclub.ro

The products and services on the site are offered subject to compliance with the provisions of this document, within the limits of available stock and/or validity (in terms of date and/or number of packages offered for sale). For this reason, we assume the right not to honor a certain order if the respective product is no longer in the current offer, does not correspond in terms of quality or certain service packages have been exhausted.
Because we only offer individual sessions, with a personal instructor and with a specific number of children per hour (maximum 4), the availability of positions is limited by these conditions.
The product prices on the site do not include delivery costs.
Payment for products ordered from the website www.acvaticbebeclub.ro can only be made online with a debit/credit card or by bank transfer (we do not accept cash on delivery).
To provide you with payment security, all our payments are processed securely by NETOPIA Mobilpay.
The delivery of the ordered product to the courier will be made once the payment has been processed/validated.
We would like to inform you that we will ship the products for sale on this site only within Romania. The shipping cost is determined depending on the destination, weight and shipping method. Products in stock will be delivered to the courier within a maximum of 3 working days.
It is your obligation to correctly transmit the delivery address data when placing an order.

We reserve the right to cancel an order placed by the buyer following prior notice to the buyer, without any further obligation of either party to the other or without either party being able to claim damages from the other in the following cases:

• non-acceptance by the bank issuing the consumer's card of the transaction, in the case of online payment;
• invalidation of the transaction by the merchant's approved card processor, in the case of online payment;
• the data provided by the buyer on the Site is incomplete and/or incorrect;
  If an ordered product cannot be delivered, you will receive information about this fact and the value of the product will be returned to your account, within a maximum of 14 days from the date we became aware of this fact.

We make constant efforts to maintain the accuracy of the information on the site, but sometimes it may contain inaccuracies and the photos are for informational purposes only and are used for presentation purposes only.
We reserve the right to modify the content of this agreement at any time, but buyers will have permanent access to the terms and conditions of use of the products and services sold by Acvatic Bebe Club so that they can consult them at any time.

OFFERS AND PROMOTIONAL CODES
At our discretion, we may offer products and services at reduced prices. These offers are valid from the time of introduction on the site until the end date of the offer, as provided on acvaticbebeclub.ro, and cannot be used for orders placed before the date of introduction of the offer or after its end date.
If you have placed an order and the price of the product and/or service ordered is subsequently reduced or reduced following a special offer, the price at the time of placing your order will apply.
We also reserve the right to provide special, personalized offers and promotions, and as a result you will only be able to enjoy the discount if you have received that special offer.
Unless expressly stated otherwise, initial free or discounted offers are valid for new users of www.acvaticbebeclub.ro services and are valid only once for a specific person.
Discounts and credit cannot be used in conjunction with any other offers.
Unless otherwise stated, only one promotional code can be used per order.

Refund policy for products offered on www.acvaticbebeclub.ro
The buyer of a product may withdraw from the distance contract within 14 calendar days according to OUG. 34/2014, by sending a written notification to [email protected]
We would appreciate it if you would mention the reason for your withdrawal from the contract, the option of replacing the product or refunding the amount in your notification. If you choose to replace the product, the shipping cost will be borne by us.
It is the buyer's obligation to return the product(s) in the same condition in which they were delivered/received within 14 days from the date of purchase, stating that he/she wishes to withdraw from the contract. Exceptions to the right of withdrawal remain in force according to legal provisions.
In any situation of returning products, they must be in the same condition in which they were sent to you in the original packaging, with the labels intact and together with all accompanying documents (invoice, warranty certificate, etc.). Products that show physical changes, bumps, chips, stains, burns, scratches, etc. or any other alterations/modifications that could affect the functionality of the product are not accepted for return.
We will refund the order value within 14 working days from the date of receipt of the return.
If, as a buyer of a product, you do not submit a notification to request withdrawal from the contract within 14 days from the date of delivery of the products, you will lose the right to withdraw from the concluded contract.
Refunds will be made using the same payment method used for the initial transaction, and the shipping fee for returning the product will be borne by you. We do not refund money in our clubs for orders placed online.

Any online order or subscription request received constitutes an offer to purchase from you for certain subscriptions or service packages, for a specific price, and is conditional upon our acceptance. We reserve the right, in our absolute discretion, to refuse any order or subscription request without any justification. In the event of a refusal, we will promptly inform you and refund or cancel any payment received in full or in part, through the payment method used to place the order or subscription request.

By placing an online order or a subscription request on www.acvaticbebeclub.ro you confirm that you are of legal age and have full capacity to conclude the Contract based on these terms and conditions.

According to art. 16 of Government Emergency Ordinance no. 34/2014 on consumer rights in contracts concluded with professionals, as well as for the amendment and completion of certain normative acts, as subsequently amended and completed, the right of withdrawal is not applicable to leisure services. As such, as a buyer of a service, at the time of placing the online order, the contract is considered to be concluded remotely and, at the same time, you assume the obligation to pay for the service, without having the right to withdraw. However, in the event that you purchase a service, the execution term of which does not enter into force within the next 7 days from the date of payment and you decide to withdraw from the contract, you will be able to receive the equivalent of 50% of the amount paid or a voucher worth 50% of the amount paid that can be given as a gift or used until the end of the year.

Any disputes will be resolved amicably between Acvatic Club and the buyer. The applicable law is the law of Romania, and the courts of Romania will have the exclusive right to resolve any conflicts or disagreements between Acvatic Club and the buyer as a result of using the Site according to these terms and conditions or of any connection with them.
