Framework and conditions of use

The information mentioned below regulates your use of the website www.acvaticbebeclub.ro. , which is the official website of the aquatic education club, Aqua Baby Club SRL, developed with the aim of constituting a general source of information regarding the method used by our instructors to initiate babies and young children into aquatic education (hereinafter referred to as the ABC method), the objectives pursued and the benefits that can result if the sessions are carried out consistently, access to the purchase and presentation of our services, information regarding our instructors as well as access to a series of press appearances and testimonials from the club's clients (from 2012 to the present). 
By accessing this site, the materials and information presented within it, you confirm that you have read, understood, accepted and agreed to the following terms and conditions.

to Aqua Baby Club SRL We are always concerned with expanding the range of products and services that we offer to our children, in order for them to gain, from their first months of life, an alternative education that will provide them with the prerequisites for complex skills and benefits throughout their entire lives.
In 2012, our story began by offering aquatic education sessions to babies (from 4 months old) and young children, continuing to rapidly expand with other services including: home program, salt therapy and physiotherapy, described on the club's website under the Services section.
For better clarity of the words used on the site and on this page, please keep in mind the following definitions and information:
“Site” hereinafter means the website https://acvaticbebeclub.ro/
“Service” means any service offered on the Site, and/or any module or component thereof;
“Appointment time” means the start time of the aquatic education session. We recommend arriving at least 10 minutes before the appointment time to allow the child to change and take the mandatory shower before entering the pool. Minutes lost due to delays on the part of the user will not be recoverable.
"User" hereinafter means any person who visits or accesses the Site, who creates an account on the Site or who wishes to use in any way or actually uses one of the services offered by the club.
"Validity Period" means the date until which sessions included in the subscription are valid and can be scheduled.
“Grace period” means the extension of the validity period by a certain number of weeks (specified according to the initial package chosen). During these weeks, missed and recoverable sessions can be scheduled, with a frequency of, plus one session per week, than the frequency of the initial package chosen in order to accelerate the recovery process of paid, recoverable and missed sessions.
"Make-up sessions" means sessions that were missed for medical reasons (based on a supporting document, which must be presented before resuming appointments) or whose absence was announced at least 24 hours before the time they were originally scheduled. 

  1. HOW TO ORDER
  • to place an online order to purchase a product or service from the club's website, we recommend that you register by clicking here. It is important that these data are correct so that there are no future problems with courier delivery or invoice issuance. By registering and using the created account, the User fully and unconditionally accepts the provisions of these Terms and Conditions and agrees to use and/or purchase the club's services in strict accordance with them. Orders can only be placed if you are at least 18 years old,
  • choose any desired service or product, after browsing the site, by accessing the Add to Cart button. For services that include aquatic education packages, pay attention to the information regarding the validity period and grace period of the chosen package, as well as the medical tests requested by the club upon registration.
  • once this button is accessed, the chosen product or service will be found in the COS (respectively at the top right of the page)
  • The shipping cost will be displayed at the cart value, in the case of products that need to physically reach you.
  • If you want to modify the contents of the cart, click on the COS button and from the opened page you can modify the quantity of each product and/or service or you can delete it.
  • If you have any comments regarding your order (questions, suggestions, etc.), please mention them in the Comments field.
  • If you want to complete the order, click the Complete order/Pay button.
  • If you choose to pay your order online, by card (our payment processor is….), you will receive an email with the validation and receipt data of your order. In the case of bank transfer, you will initially receive a PROFORMA INVOICE, and the validation data will be sent to you after payment confirmation. We do not accept cash on delivery!
  • The delivery of the products and/or gift vouchers will be made to the courier company chosen by the club within a maximum of 48 hours, after confirmation of payment (by bank transfer or online).
  • aquatic education sessions can be scheduled through the club's reception department, by phone or email (contact@acvaticbebeclub). Access to the club will be granted, from the first session, only upon presentation of the medical tests requested by the club and adequate equipment for the child (water diapers and fish briefs, slippers intended for wet surfaces, helmet and swimming goggles after the age of 3, towel)

2. Site ownership and intellectual property rights
The entire content of the site is protected by Copyright Law, all rights reserved.
This website is owned and maintained by Acvatic Bebe Club. Unless otherwise stated, all intellectual property rights (including copyright and database rights) in the trademarks, service marks, logos and all other materials displayed on this website belong to Acvatic Bebe Club. Aqua Baby Club SRL, trademark registered with OSIM, based on registration certificate no. 167550.
Aqua Baby Club SRL reserves all rights with respect to the above and will exercise such rights as may be necessary to the fullest extent permitted by law. Nothing contained in this site constitutes a license or right to use any image, trademark, service mark, logo or other material displayed on the site by any person. Reproduction, distribution or publication of materials on the site by any person without the prior written consent of Aqua Baby Club SRL.
Downloading or copying material from the site by other means does not transfer to the person concerned the rights to the materials on the site. Any data transmitted to this site becomes the property of Acvatic Bebe Club, may be used by Acvatic Bebe Club for any purpose if it falls within the limits of the law and may be disclosed at its discretion, including to any type of authorities. You are responsible for complying with all laws and regulations that apply to you.

We are committed to respecting your personal data and complying with applicable legal provisions regarding its protection.


4. What is personal data?
Personal data is information about a natural person such as name and surname, address, date of birth, telephone number, email, identity data, number and age of children, parental status, etc. As a rule, we receive this data from you when you fill out a form, online or on paper, sign a contract, send us a message, email or talk on the phone.

5. For what purpose do we process the data?
Aqua Baby Club SRL processes personal data for the provision of offers for educational products and services (for example: for making an appointment, recommending certain services specific to certain age categories), concluding and executing contracts, for internal analyses aimed at improving and developing products and services, for identifying and preventing fraud, marketing, by sending general or personalized offers of Aqua Baby Club SRL or its partners, statistics, market research, fulfillment of legal obligations, etc.


6. Conditions under which your data is processed?
Aqua Baby Club SRL processes data only with your consent, when it has a legal obligation or can justify an overriding legitimate interest.
We take the security of your data very seriously, by adopting and periodically reviewing security, technical and organizational measures, designed to protect data against unauthorized access, modification, disclosure or unauthorized destruction. Access to data is allowed only to persons authorized by Aqua Baby Club SRL who have previously assumed confidentiality obligations.
The processing of your personal data will be carried out for the entire period necessary to fulfill the purposes for which they were collected.

What are your rights?

  • You have the right to be informed about your personal data that Aqua Baby Club SRL owns them
  • You have the right to request the deletion or updating of incomplete, incorrect or outdated data.
  • You have the right, for justified and legitimate reasons, to object to certain data processing, except in cases where there are legal provisions to the contrary or we will not be able to provide you with the requested services in the absence of such data.
  • You have the right to request the cessation of the processing of your data for direct marketing purposes or for the creation of personalized offers.

The Club reserves the right to modify this statement at any time. The version published on the website is the one in force.


7. Limitation of liability
Under no circumstances, Aqua Baby Club SRL is not liable for any damage (direct or indirect) caused to you or any other party, relating to the use of this site and the information it contains - by you or another person.
Aqua Baby Club SRL reserves the right to be indemnified or discharged, together with its employees, from any liability or legal fee, damage, loss, cost and any other expense in relation to claims or actions brought against the club, arising from any breach by you of the Terms and Conditions or other responsibilities arising from the use of this site.

Even though we have taken every measure to ensure that the information presented on this site is accurate and correct, neither Aqua Baby Club SRL cannot be held liable for any inaccuracies that may appear on this site. Users are responsible for evaluating the accuracy, completeness and usefulness of the information available on this site.
The information contained or made available through the site cannot replace or substitute the services of trained professionals in fields such as medical, psychological, etc. In particular, as parents, you should consult a doctor regularly, in all aspects related to the physical or mental health of your child, especially regarding any symptoms that may require diagnosis or medical care. As a parent or person who is involved in the care and education of the child, you are solely responsible for the decisions, actions and results in life, at all times, in all circumstances.
We constantly strive to ensure that our programs have the ability to educate young children in aquatic education and initiation into swimming procedures to help them learn important aquatic skills. However, there is no guarantee that they will achieve, within a certain time frame, a result expected by you if there is no consistency and perseverance objectively associated with the expected results, in terms of attendance at aquatic education sessions along with your physical and emotional support, in this endeavor.
The level of success in aquatic, motor, social and cognitive skills that can be developed as a result of participating in aquatic education sessions depends on a number of factors, including genetic factors, capacity, dedication, empathy, to name a few. Because these factors differ depending on the pace of evolution and adaptation of each child, we cannot and do not guarantee success within a defined time frame. Any forward-looking statements presented on our website are simply our opinion. 

8.Legal aspects
Any claim or dispute arising out of or related to the use of this site, its content or the materials contained herein will be governed by Romanian law in force.
The terms and conditions of use of this site may be changed at any time without prior notice. You agree to review this section of the site regularly, and your continued access or use of this site will constitute evidence of your agreement to such changes.
Aqua Baby Club SRL undertakes to treat the personal details obtained in accordance with the Romanian legislation in force.


9.Linking to other sites
The site may contain web links or references to other sites considered by Aqua Baby Club SRL useful in terms of the content of its site and which are not necessarily under our control or guidance.
When using these web links or references, the general terms of use corresponding to those sites will apply.
In these cases, AAqua Baby Club SRL cannot guarantee/control the timeliness/accuracy of the information present on third-party websites, to which reference is made from its website.


10. Technical limitations of the services
The Administrator assumes no responsibility if the site's services cannot be accessed by Users, for an unlimited period of time, for any technical or commercial reasons.

11. Updates to the Terms and Conditions
We may need to revise this page in the future, in which case we will indicate the updated version by changing the "Last Updated" date at the top of the Terms and Conditions. After the date on which the updated version becomes effective (within 48 hours of publication), accessing our site will constitute your acceptance of the updated Terms and Conditions.
This version of this page has been written in English and Romanian and in case of any inconsistencies between the two versions, the Romanian version will prevail.
